ARTICLE 1. SUBJECT

The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.

  

ARTICLE 2. PARTIES

This shipping policy is applicable between IBELIV BY LIV, SARL, share capital: 1000 €, registered at the RCS of Avignon in France on 01/10/2013, under the number 797639713, registered office: 10 Avenue de Fontcouverte, France, phone: +33785555071, email: contact@ibeliv.fr, VAT number: FR58797639713, hereinafter "the Publisher" and any person, natural or legal, of private or public law, registered on the Site to purchase a Product, hereinafter "the Customer".

  

ARTICLE 3. DEFINITIONS

" Customer ": any person, natural or legal, private or public, registered on the Site.

" Site Content" : elements of any kind published on the Site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases or software. 

The "Publisher ": IBELIV BY LIV, SARL in its capacity as publisher of the Site.

 " Internet user ": any person, natural or legal, private or public, connecting to the Site.

" Product ": goods of any kind sold on the Site by the Publisher to Customers.

" Site " means the website accessible at the URL www.ibeliv.fr, and any sub-sites, mirror sites, portals and URL variations thereof.

 

ARTICLE 4. SCOPE OF APPLICATION

The Site is freely accessible to all Internet users. Browsing the Site implies acceptance by all Internet users of this shipping policy. Simply connecting to the Site, by any means whatsoever, in particular via a robot or a browser, shall imply full and complete acceptance of this shipping policy. When registering on the Site, this acceptance will be confirmed by ticking the corresponding box.

The Internet user acknowledges that he/she has fully understood and accepts them without restriction.

Checking the above-mentioned box shall be deemed to have the same value as a handwritten signature by the Internet user. The Internet User acknowledges the value of the Publisher's automatic recording systems as proof and, unless he/she can prove otherwise, he/she waives the right to contest them in the event of a dispute.

The present shipping policy is applicable to the relationship between the parties to the exclusion of all other conditions, and in particular those of the Internet user.

Acceptance of this shipping policy implies that Internet users have the legal capacity to do so, or failing that, that they have the authorisation of a guardian or curator if they are incapable, of their legal representative if they are minors, or that they hold a mandate if they are acting on behalf of a legal entity.

 

ARTICLE 5. DELIVERY

5.1. Delivery costs

The cost of delivery or provision will, in any event, be indicated to the Customer before any payment is made. For any other place of delivery, it is up to the Customer to contact the customer service.

The delivery costs indicated on the Site are understood to be in euros, including all taxes.

 

5.2. Delivery time

Orders are delivered within 1 to 10 working days (depending on the place of delivery) from the date of full payment by the Publisher. 

Certain products or certain order volumes may nevertheless justify a longer delivery time. This will be expressly mentioned to the Customer when the order is validated.

 

5.3. Deteriorated parcel

In the event of delivery of an obviously and visibly damaged package, it is up to the Customer to refuse it in order to benefit from the guarantee offered by the carrier. The Customer must also inform the seller without delay, so that a new parcel can be prepared and sent to him upon receipt of the damaged parcel. In such a case, the delivery times indicated above in these general conditions will no longer apply.

 

5.4. Retention of title - transfer of risk

Ownership of the delivered Products shall remain with the Publisher until delivery of the Products to the Customer, notwithstanding any clause to the contrary, unless the parties have expressly agreed in writing to waive this clause.

The Customer shall bear the risks relating to the Products from the time of order. For the duration of the retention of title, the Customer shall insure the Products belonging to the Publisher at its own expense against any damage that may occur and shall provide proof thereof to the Publisher on first request.


ARTICLE 6. FINAL PROVISIONS

6.1. Applicable law

This shipping policy is subject to the application of French law.

 

6.2. Changes to this shipping policy

This shipping policy may be modified at any time by the Publisher. The shipping policy applicable to the Customer is the one in force on the day of his order or his connection to the present Site, any new connection to the personal space implying acceptance of the new shipping policy, if applicable.

 

6.3. Disputes

Pursuant to the order n°2015-1033 of 20 August 2015, any dispute with a consumer Customer that may arise in the context of the execution of these general conditions and for which no amicable solution has been found between the parties shall be submitted to Medicys: www.medicys.fr.

In addition, the consumer Customer is informed of the existence of the online dispute resolution platform, accessible at the following URL https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

Any dispute arising out of or in connection with this contract shall be settled by arbitration in accordance with the rules of the Digital Institute of Arbitration and Mediation: www.fast-arbitre.com.

 

6.4. Entire

The nullity of one of the clauses of this contract shall not entail the nullity of the other clauses of the contract or of the contract as a whole, which shall retain their full effect and scope. In such a case, the parties shall, as far as possible, replace the invalidated provision with a valid provision corresponding to the spirit and purpose of this agreement.

 

6.5. Non-waiver

The Publisher's failure to exercise its rights hereunder shall in no way be construed as a waiver of such rights.

 

6.6. Canvassing

The Customer is informed that he/she has the possibility to register on the telephone anti-solicitation list at http://www.bloctel.gouv.fr/.

 

6.7. Unfair terms

The provisions of this dispatch policy apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair terms in contracts concluded between a professional and a consumer.

 

ARTICLE 7. SHIPPING & RETURNS 

Article 7.1. Specific shipping conditions for the shop

- Free delivery in Europe. 
- International delivery ensured by FedEx (International Economy or International Priority, depending on the choice made by the customer) - Due to the devices put in place to protect us from COVID-19, delivery times are likely to be disrupted. We do our best to ship your package as quickly as possible.

 

Article 7.2. Shipment schedule and cut-off times, specific to the shop

All orders received before 11:00 CET are shipped the same day (working day only). Therefore, orders received after this time will be shipped the next day.

 

Article 7.3. Shop-specific returns policies

The return of your order is accepted, provided that your request for withdrawal is made within 14 days from the date of delivery. You will be responsible for the return shipping costs. 

To ensure that the return and refund are carried out in the best conditions, please strictly follow the procedure below (otherwise we reserve the right to refuse the refund) 

Write to us at contact@ibeliv.fr with your order number, to inform us of your request for withdrawal. From this date, you have 14 days to return the products to us (shipping date). 

Please ensure that all products are in their original packaging, unused and in perfect condition. Any product that has been damaged will not be refunded.

Please enclose in your package with the product(s) in question, the number of the order concerned as well as your name and surname.
